1. Acceptance of Terms
By downloading, accessing, or using the FlykMote mobile application (“the App”), you agree to be bound by these Terms of Use (“Terms”) and any additional policies referenced herein, including our Privacy Policy.
These Terms of Use govern your access to and use of FlykMote’s features, services, and AI-powered functionality. Your license to download and use the FlykMote application is also subject to Apple’s Standard Licensed Application End User License Agreement. If these Terms conflict with Apple’s Standard EULA regarding the license to use the application, Apple’s Standard EULA will control.
If you do not agree to these Terms, you must not use the App.
2. Use of the App
License
We grant you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, in accordance with these Terms.
Restrictions
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App
- Copy, modify, or create derivative works based on the App
- Use the App for any unlawful or unauthorized purpose
- Use the App in a way that interferes with its normal operation
- Exploit the App or its outputs for commercial purposes without prior written consent
3. AI Features and Recommendations
FlykMote provides AI-powered features, including natural language commands and entertainment recommendations, such as movies or shows based on your mood or context.
Nature of AI Output
- All AI-generated outputs are provided for informational and convenience purposes only
- Recommendations may not always be accurate, complete, or up-to-date
- Availability of content across streaming platforms may vary by region and over time
No Guarantees
We do not guarantee:
- That recommendations will match your preferences
- That suggested content will be available on your subscriptions
- That AI responses will always be accurate or error-free
You are responsible for verifying content availability and making your own viewing decisions.
AI-powered features are subject to a fair usage limit of up to 180 requests per subscription month. The allowance resets at the start of each new subscription period and does not roll over. FlykMote may restrict access to AI-powered features in cases of automated, abusive, fraudulent, or unauthorized use.
4. Remote Control Functionality
FlykMote allows you to control compatible devices such as TVs or streaming devices.
By using this feature:
- You agree to use the App only with devices you own or are authorized to control
- You acknowledge that device compatibility may vary
- You understand that certain actions, such as launching apps or search behavior, depend on third-party platforms and may not always function as expected
We are not responsible for limitations, disruptions, or changes in third-party device behavior.
5. User Conduct
You agree not to use the App to:
- Engage in unlawful, harmful, or abusive activity
- Interfere with other users or systems
- Attempt unauthorized access to devices, networks, or services
- Misuse AI features, including generating harmful, misleading, or abusive content
You are solely responsible for how you use the App and any outcomes resulting from its use.
6. Advertising
The App may display advertisements provided by third-party ad networks, such as inMobi.
By using the App, you consent to:
- The display of advertisements
- Limited data usage by ad partners for ad delivery and performance measurement, in accordance with their privacy policies
7. Analytics
We use analytics tools, such as Firebase Analytics, to collect aggregated, non-identifiable data about app usage, performance, and crashes. This helps us improve the App experience.
8. In-App Purchases and Subscriptions
FlykMote may offer paid features through subscriptions or one-time purchases via Apple’s In-App Purchase system.
- All payments are processed by Apple
- We do not collect or store payment information
- Purchases are subject to Apple’s terms and conditions
Subscriptions
- Subscriptions automatically renew unless cancelled through your Apple ID settings
- You can manage or cancel subscriptions at any time through your device settings
Refunds
All purchases are handled by Apple, and refund requests must be directed to Apple.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, if:
- You violate these Terms
- Your use poses a risk to the App, users, or third parties
- Required by law or regulatory authorities
10. Disclaimers
App Provided “As Is”
FlykMote is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
We do not guarantee that:
- The App will be uninterrupted or error-free
- Features will always function as expected
- The App will be compatible with all devices
AI Disclaimer
AI-generated outputs may be incomplete, inaccurate, or outdated. They should not be relied upon as definitive recommendations or advice.
11. Limitation of Liability
To the fullest extent permitted by law, FlykMote and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including:
- Loss of data
- Loss of profits
- Device or service disruptions
arising out of or related to your use, or inability to use, the App.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
13. Changes to These Terms
We may update these Terms from time to time. When material changes are made:
- We will update the “Last Updated” date
- We may notify users within the App
Continued use of the App after updates constitutes acceptance of the revised Terms.
